Prohibited Uses & Compliance

What you may not do with PhoenixDms — and how we enforce it. Written for legitimate professional automotive diagnostic businesses.

PhoenixDms LLC provides PhoenixDms as a B2B software and digital services platform for professional automotive diagnostic businesses, with usage credits, desktop tools, and a verified reseller network. PhoenixDms provides the software infrastructure used by authorized automotive professionals and verified partners to manage eligible remote diagnostic workflows. Customers and partners remain responsible for how remote diagnostic operations are used with end vehicles and for obtaining required authorization. This page sets platform rules that sit alongside our Terms of Service. It is not legal advice; consult counsel for your jurisdiction.

Emissions defeat, safety sabotage, odometer fraud, theft facilitation, piracy.

Allowed (examples)

Authorized diagnostics, lawful maintenance, documented off-road / competition use.

Enforcement

We may suspend accounts and cooperate with lawful authority requests.

Why this exists

Diagnostic and calibration tooling can be misused in ways that break environmental, safety, theft, or IP laws. We design PhoenixDms for lawful professional operations. We do not host a classified “services marketplace,” but we still prohibit using our accounts, APIs, branding, or distribution channels to enable illegal activity.

Federal exposure

Emissions defeat and odometer fraud can carry serious US federal consequences. Clear evidence of facilitation may lead to termination and cooperation with regulators or law enforcement.

Certain vehicle tampering practices are treated seriously under United States federal law — including provisions of the Clean Air Act related to defeating emissions controls, and federal odometer statutes related to mileage fraud. Where we become aware of clear evidence that a PhoenixDms account is being used to facilitate such crimes, we may terminate access, retain records as required, and cooperate with lawful requests from regulators or law enforcement. Civil and criminal exposure can fall on the actor — not only on the software vendor.

Strictly forbidden uses of PhoenixDms

You must not use PhoenixDms (including the website, APIs, admin/reseller panels, or desktop client) to:

Emissions and environmental defeat

  • Distribute or operationalize defeat of required emissions controls on road vehicles (for example DPF/EGR/SCR/AdBlue/catalyst defeat workflows marketed for public-road use).
  • Package “delete” calibrations or bypass kits as a product line through our licensing or desktop delivery when intended for illegal on-road use.

Safety system sabotage on road vehicles

  • Disable or defeat airbags, ABS/ESC, seatbelt interlocks, or similar FMVSS-relevant protections for vehicles used on public roads.
  • Remove or defeat speed limiters on road-registered vehicles where doing so violates applicable law.

Mileage and history fraud

  • Alter odometer readings or instrument data to misrepresent vehicle mileage or history.
  • Assist title washing, clocking, or similar deception.

Unauthorized remote access & vehicle crime

  • Remote diagnostic access to vehicles without the owner’s / authorized custodian’s consent.
  • Operations on stolen, cloned, or unverified vehicles; using PhoenixDms to facilitate vehicle theft.
  • Immobilizer bypass, key programming, or security-system defeat without documented authorization.
  • Selling “crack”, keygen, license emulator, or pirated diagnostic software through our platform.

Theft facilitation

  • Immobilizer bypass, key cloning, or ECU/module programming without reasonable ownership / authorization checks.
  • Services aimed at stolen or unverified vehicles.

IP, licensing, and platform abuse

  • Pirated OEM or third-party diagnostic software, cracks, keygens, or license emulators.
  • Circumventing PhoenixDms licensing, seat limits, HWID controls, or reseller branding contracts.
  • Sharing credentials to evade paid seats; scraping, probing, or attacking our infrastructure.
  • Fraudulent payments, money laundering, sanctions evasion, or export-control violations.

Legitimate professional use (examples)

Subject to local law and manufacturer rules, the following are generally consistent with intended use:

  • Authorized diagnostic, coding, and maintenance workflows for owned or customer vehicles with proper consent.
  • Performance work that keeps emissions and safety systems intact and legal for the vehicle’s registration class.
  • Closed-course / competition / dedicated off-road or marine applications where the operator documents lawful use and no illegal defeat of road emissions equipment is involved.
  • Pre-control classic vehicles where no factory emissions equipment existed — only with accurate year/equipment verification.

“Track only” or “off-road only” claims do not excuse using PhoenixDms to push illegal on-road defeat products at scale. Partners must follow Partner Verification standards. Partners.

Enforcement

  • Investigation of reports and automated/manual risk signals
  • Suspension or permanent closure of accounts
  • Forfeiture of pending reseller payouts where contractually allowed
  • Refusal of future service; cooperation with lawful authority requests

Termination for serious abuse may affect unused prepaid balances as described in the Refunds policy and your reseller agreement. Refunds, Credits & Cancellations.

Report misuse

Email legal@phoenixdms.com or support@phoenixdms.com with account identifiers, URLs, screenshots, and a short description. Good-faith reporters help keep the ecosystem viable for legitimate shops.
